Dr. Nien-Tsu Alfred Hu:「The Cultural Properties Preservation Act and the Orientation as well as the Content of a Proposed Specific Legislation on the Underwater Cultural Heritage Preservation, Protection and Management Act」
Abstract
The adoption of the Convention on the Protection of the Underwater Cultural Heritage by the UNESCO in 2001 symbolizes a maturing development of international legislation regarding the preservation, protection and management of underwater cultural heritage. Taiwan needs a specific law to fulfill its national rights and the obligations conferred upon it by such international conventions, and thereby implement the preservation, protection and management of underwater cultural heritage, despite Taiwan not being a member of UNESCO. This paper firstly reviews the deficiencies with respect to the preservation, protection and management of underwater cultural heritage within the existing Cultural Properties Preservation Act, then demonstrates the efforts that academia has devoted to legislation for the preservation, protection and management of underwater cultural heritage within recent years. Finally, it discusses certain important principles and elements that ought to be brought into the proposed Underwater Cultural Heritage Preservation, Protection and Management Act during its drafting phase.
